Legal information
Applicable to all Malo'Way bike and equipment bookings. Version of 18 October 2026.
These general rental terms and conditions (the “Terms”) govern all bookings and rentals of bicycles and equipment from Malo'Way, in particular when the request is made on the maloway.fr website. By sending a booking request, the customer (the “Renter”) acknowledges having read and accepted these Terms. The rental agreement signed when the equipment is handed over supplements them; in the event of any contradiction, the signed agreement prevails.
Malo'Way — sole proprietorship (micro-entreprise) run by Nathan Bras — SIRET 944 724 368 00013 — 21 rue Beauséjour, 35400 Saint-Malo, France. Phone: +33 7 80 97 00 58 — email: maloway35400@gmail.com.
Malo'Way offers short-term rental of adult and child bicycles and equipment (helmets, baskets, child seats, trailers, phone holders), the “On-site breakdown assistance” and “Damage & theft cover” options and, on request, delivery and collection of the equipment.
Malo'Way also rents out inflatable stand-up paddleboards, supplied as a complete kit (board, paddle, pump, leash, buoyancy aid and carry bag). This is an equipment-only rental, with no supervision, lessons or lifeguarding: Malo'Way does not organise any water activity.
Booking requests can be made on the website, by phone or by message. A request sent online is not a confirmed booking: it only becomes final once confirmed by Malo'Way (email, phone or message), subject to availability. Malo'Way may decline a request, in particular if the equipment is unavailable.
The Renter is of legal age, guarantees the accuracy of the information provided and shows an identity document when the equipment is handed over.
Prices are in euros, all taxes included (VAT not applicable, Article 293 B of the French General Tax Code). They are shown on the Prices page and depend on the rental period (half-day from 2 pm to 6:30 pm, day, multi-day packages, extra days beyond one week).
The quote displayed with the online request is an indicative estimate based on this price list. The final price is the one confirmed by Malo'Way and stated in the rental agreement. Any delivery fees are communicated before confirmation.
Options are charged per bicycle and apply to all bicycles in the rental. They are chosen when booking or, at the latest, when the equipment is handed over, before departure.
5.1 On-site breakdown assistance. In the event of a breakdown, puncture or mechanical failure, Malo'Way provides on-site assistance from 9 am to 7 pm, within 20 km of 21 rue Beauséjour in Saint-Malo, within an indicative time of one hour (except at peak times). If the bicycle cannot be repaired on site, it is replaced subject to availability or collected by Malo'Way. Repairs made necessary by improper use or damage remain chargeable (Articles 10 and 5.2). Outside this radius or these hours, returning the bicycle remains the Renter's responsibility.
5.2 Damage & theft cover. It covers all rented bicycles and equipment. The Renter's liability under Article 10 is then limited to: €0 for damage to accessories and equipment (excluding bicycles and trailers); €50 per bicycle or trailer for major damage; €100 per bicycle or trailer in the event of theft, provided the bicycle was locked by the frame to a fixed point with the lock provided, a police report was filed within 24 hours and the lock key is returned to Malo'Way. The cover does not apply in the event of a breach of the rules of use (Article 9), gross negligence, intentional misconduct or loss (other than reported theft). It is a contractual limitation of liability granted by Malo'Way; it is not an insurance contract and covers neither bodily injury nor the Renter's civil liability towards third parties. It is non-refundable once the rental has started.
5.3 Peace of Mind Pack. When breakdown assistance and damage & theft cover are taken together, a discount per bicycle is applied automatically, according to the Prices page.
No payment is requested online. The total price is payable at the latest when the equipment is handed over, using the payment methods accepted by Malo'Way. Malo'Way may request a security deposit (cash or card pre-authorisation), returned when the equipment is returned in good condition; its amount does not limit the Renter's liability.
By the Renter: as no payment is made when booking, the Renter may cancel or change the booking free of charge by informing Malo'Way as early as possible (phone, email or message).
By Malo'Way: if the equipment is unavailable, in the event of force majeure or dangerous weather, Malo'Way may cancel the booking; it informs the Renter as soon as possible and refunds in full any sums paid, without further compensation.
In accordance with Article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure rental services provided on a specific date or for a specific period.
The equipment is handed over at 21 rue Beauséjour by appointment, between 9 am and 7 pm, or delivered to the agreed address. It is handed over in good working order and fitted with the mandatory safety accessories; the Renter checks it before departure and reports any defect before leaving.
The Renter uses the equipment carefully and in compliance with the French Highway Code. In particular, it is prohibited to ride on the beach, in sand, in seawater or on unsuitable tracks, to perform jumps or stunts, to carry a passenger other than in a dedicated child seat, to ride under the influence of alcohol or drugs, and to sub-let or lend the equipment. Helmets are mandatory for children under 12, whether riders or passengers. At every stop, the bicycle must be locked by the frame to a fixed point with the lock provided.
The equipment is returned on the agreed date, time and place. Any late return is charged at the rate of one extra day per day started, and one half-day for a delay of more than 2 hours. No refund is due for early return. If the equipment has not been returned and the Renter cannot be reached 24 hours after the agreed time, it is considered misappropriated and Malo'Way may file a police complaint.
Conditions of use. The Renter declares that they can swim and are fit to paddleboard, and makes sure the same applies to everyone they let use the equipment. Minors may only use the paddleboard under the Renter's supervision and responsibility. On the water, wearing the ankle leash and the buoyancy aid provided is mandatory. The paddleboard may only be used in daylight and within 300 metres of the shore, outside marked swimming areas, channels and harbour areas, in compliance with maritime regulations and local by-laws.
Weather and tides. Before each outing, the Renter checks the weather, the wind and the tide times. They do not go out in strong wind, offshore wind (which pushes away from the shore), rough sea, fog or storms. The Renter alone decides whether an outing is appropriate. Malo'Way may refuse or postpone the handover of a paddleboard if dangerous conditions are forecast (article 7).
Transport and care. The paddleboard is carried deflated in its bag or carried by hand. It must not be dragged on the ground or rocks, nor left inflated in full sun. It is returned deflated, with all its accessories.
Security deposit. A security deposit of €300 per paddleboard is required when the kit is handed over (cash or card pre-authorisation). It is returned when the complete kit is brought back in good condition, minus any amounts due according to the table below.
Damage, loss and theft. Unless the damage & theft cover has been taken out, the Renter owes the following amounts:
| Item | Amount due |
|---|---|
| Paddleboard (theft, loss or major damage to the board) | 300 € |
| Repairable puncture or tear | 40 € |
| Fin | 20 € |
| Paddle | 40 € |
| Pump | 25 € |
| Buoyancy aid | 30 € |
| Leash | 15 € |
| Carry bag | 25 € |
Damage & theft cover. The cover in article 5.2 can be taken out for paddleboards, at the “Damage & theft cover (paddleboard)” rate shown on the Prices page, per paddleboard. The Renter's liability is then limited to €0 for damage to accessories and routine repairs (puncture, fin), €50 per paddleboard for major damage and €100 per paddleboard for theft, provided a police report is filed within 24 hours. It does not cover loss at sea (board or accessory carried away by wind or current) or use contrary to this article. Breakdown assistance and the Peace of Mind Pack discount do not apply to paddleboards.
Risks. Paddleboarding involves risks (falls, drifting, collision, drowning). The Renter is aware of them and looks after their own safety and that of the people they let use the equipment. Malo'Way is liable for damage resulting from a defect in the equipment attributable to it (article 10).
The Renter has custody of the equipment for the whole rental and is responsible for the people using it. The Renter is liable for damage caused to third parties and declares to hold civil liability insurance. Malo'Way, covered by professional liability insurance, is liable for damage resulting from a defect in the equipment attributable to it.
Unless the damage & theft cover has been taken (Article 5.2), the Renter shall pay the following amounts for any damage, loss or theft:
| Item | Amount due |
|---|---|
| Bicycle (theft, loss or major damage) | €300 |
| Trailer | €250 |
| Child seat | €60 |
| Saddle | €50 |
| Basket | €30 |
| Helmet | €20 |
| Kickstand | €20 |
| Phone holder | €15 |
| Grips | €10 |
| Key / lock | €5 |
Any damage not listed is charged at the actual cost of repair (parts and labour), up to the replacement value of the equipment. In the event of theft, the Renter informs Malo'Way immediately and files a police report within 24 hours.
Without the breakdown option, in the event of a breakdown, puncture or mechanical failure, the Renter returns the bicycle to 21 rue Beauséjour at their own expense; on-site assistance may be offered for an additional fee. A breakdown does not give rise to any refund, unless it results from a defect attributable to Malo'Way and the bicycle could not be replaced.
The data provided when booking is used solely to manage the rental. How it is processed is described in our privacy policy.
These Terms are governed by French law. Any complaint should be sent in writing to Malo'Way (21 rue Beauséjour, 35400 Saint-Malo, France, or maloway35400@gmail.com), which will endeavour to respond quickly and find an amicable solution. Failing agreement, the dispute will be brought before the competent court.
These Terms are available in several languages. In the event of any discrepancy, the French version prevails.
